Immigration Update: Higher Penalties on Employers Take Effect March 27

Timing is everything. There's no mercy for the business community as individual firms and industries are being made to suffer because of the federal government’s failure to update, and competently respond to, the influx of illegal immigrants into the United States over the course of many years. Unfortunately, the issue is now so complex and political that even common sense solutions fail to get any traction.

Newspapers, news sites and television news regularly report on stories regarding the federal government’s crackdown on businesses (raids) in their effort to hunt down illegal immigrants. The federal government is also attempting to advance new regulations that squarely burden businesses with new and impractical procedures for weeding out legal employees from illegal ones.

Recently, the Department of Homeland Security (DHS) and Department of Justice (DoJ) utilized a tool to ratchet up civil penalties on businesses that break paperwork and hiring rules. Monetary penalties are set to increase due to an “inflation adjustment.” These higher civil penalties take effect March 27, 2008.
